Update: Supreme Court justices expressed skepticism of Donald Trump’s argument that presidents enjoy broad immunity, but they wrestled with which certain official acts could be shielded from prosecution and which would not.
There were some suggestions of sending the case base to lower courts to decide, on an individual basis, which of the charges against Trump could be deemed as private acts and subject to criminal liability. That is a prospect that could lead to further delay in Trump’s election conspiracy case, perhaps until after the 2024 election.
A number of the justices expressed concerns that their decision in the case would impact future presidents after they leave office and the extent to which they could be subject to criminal prosecution. Justice Samuel Alito hypothesized about political rivals being prosecuted and “a cycle that destabilizes the functioning of our country.”

Now that Colorado and Maine have disqualified Donald Trump from their 2024 ballots, citing the 14th Amendment, the case will most likely go to the Supreme Court. But Rep. Jamie Raskin said Sunday that Justice Clarence Thomas “absolutely should recuse himself” from these upcoming rulings because of his wife’s involvement in Jan. 6 and the fake electors scheme.
The 14th Amendment states that anyone who “engaged in insurrection” or gave “aid and comfort” to insurrectionists is disqualified from holding future office. Raskin and seven fellow Democratic members of the House Judiciary Committee...

Clarence Thomas attended donor events hosted by the billionaire Koch brothers — whose organizations and legal projects regularly appear before the Supreme Court. According to a report from ProPublica, the Supreme Court justice has appeared at least two summits hosted by the wealthy conservatives, one of which had been previously reported on, and a second which was not disclosed.
Most recently, Thomas appeared as a speaker at an exclusive dinner for high-level donors during the Koch network’s 2018 Palm Springs summit. One former Koch network executive told ProPublica that these kinds...

As the Supreme Court prepared to decide the Citizens United case that designated money as political speech, Ginni Thomas — wife of Justice Clarence Thomas — along with conservative activists quickly and quietly filed to create exactly the type of non-profit group that would benefit from the decision, Politico reports.
In the ensuing years, according to Politico, Thomas worked closely with Federalist Society leader Leonard Leo to build a conservative movement that would fuel changes to the judiciary and help overturn laws regarding abortion, affirmative action, and other issues important to the right wing.

MSNBC’s Chris Hayes spent most of Friday’s episode of his show talking about the latest damning development in the continuing scandal involving Supreme Court Justice Clarence Thomas.
And the “All In” host had one big question looming over the whole discussion: “Just how much money has secretly flowed from right-wing donors and interests into the household of Supreme Court Justice Clarence Thomas?”
For the last several weeks, Thomas has been beset by a steadily growing number of allegations of corruption. It started with the revelation that he has received lavishly expensive gifts from right wing billionaire Harlan Crow and only grew from there. The latest developments though are particularly serious.
The Washington Post reported on Thursday that right wing judicial activist Leonard Leo, former vice president of the conservative Federalist Society, had paid Ginni Thomas, Clarence Thomas’ wife, tens of thousands of dollars for unspecified consulting back in 2012. What’s worse,...

Supreme Court Justice Clarence Thomas and his family sold $133,000 worth of real estate properties to conservative billionaire (and collector of Nazi memorabilia) Harlan Crow — without disclosing the transaction as required by federal ethics laws, according to ProPublica. The report published Thursday expands on previous reporting linking Thomas to a string of expensive, unreported gifts from Crow.
According to the report, Crow purchased a house and two lots owned by Thomas, his mother, and relatives of his deceased brother in 2014. Crow would go on to spend tens of thousands of dollars...

Conservative Supreme Court Justice Clarence Thomas has been regularly taking luxury trips financed by a billionaire Republican donor for over 20 years, according to a new investigation from ProPublica.
Thomas “virtually every year” has accepted rides on private jets, stays at private resorts, and invitations to hang out on superyachts owned by real-estate mogul Harlan Crow. Cross began with Kelly, who called her a “dumbass” and “the most racist person on television” after Cross called the NFL’s mishandling of quarterback’s concussion an example of “complete disregard for Black bodies and Black life.”
“Yes, I know. Megyn Kelly — the Blackface expert — had a lot to say about me this week based on something I actually never said. So I just want to tell her, you swung and you missed,” Cross said at the start of the segment.

The January 6th Committee holds what may be its last public hearing on Thursday, as it tries to present the public with a narrative of Donald Trump’s efforts to overturn the results of the 2020 presidential election.
After a summer pause, the hearing is expected to be the final chance for the committee to lay out its findings in advance of the midterms elections, in which a number of Trump’s defenders are seeking offices that will oversee the next presidential vote. All indications are that the afternoon hearing will once again use TV-news style production techniques, briskly going through the evidence with the use of graphics, clips and succinct witness testimony.
Among those who have been covering the hearings — and the aftermath of January 6th — is Robert Costa, who joined CBS News early this year. He authored Peril with Bob Woodward and, in March, they broke the news that Ginni Thomas,...

The CNN image for the past few years has been embodied by passionate on-air personalities like Don Lemon or Brianna Keilar. These days, it might best be symbolized by beat reporters like Jamie Gangel or Kaitlan Collins.
Gone in recent weeks (for the most part) are what had become the network’s signature red-versus-blue showdowns between hot-talking contributors or segments that hinge on an anchor scolding an interviewee. Many of Hollywood’s biggest names have slammed the Supreme Court’s majority decision to overturn Roe v. Wade and end the protection of abortion access at a federal level. But some in Hollywood, like Samuel L. Jackson, are also looking deeper into the concurring opinions in the case of Dobbs v. Jackson Women’s Health, particularly one written by Justice Clarence Thomas.
While Thomas joined Justice Alito’s majority opinion that overturned Roe v. Wade and Planned Parenthood v. Casey, he also wrote a concurring opinion that went much further.
Thomas used the concurrence to air his grievances with substantive due process, a legal idea that says certain rights can and should be protected by courts, even if not specifically enumerated in the Constitution. The idea of substantive due process allowed abortion to remain protected for nearly 50 years despite not being mentioned in the Constitution or explicitly legalized in a federal statute.

Joe Scarborough took to task Justice Clarence Thomas’ much-publicized concurring opinion – which takes aim at contraception access and same-sex marriage rights but not interracial marriage – exclaiming that the “hypocrisy is extraordinary” on Monday’s “Morning Joe.”
In his opinion to the Supreme Court’s Dobbs decision overturning Roe v. Wade, Justice Clarence Thomas wrote on Friday that abortion is just the beginning:
“In future cases, we should reconsider all of this Court’s substantive due process precedents, including Griswold, Lawrence, and Obergefell,” he wrote, effectively drawing a bead on previously codified rights. “Because any substantive due process decision is ‘demonstrably erroneous,’ we have a duty to ‘correct the error’ established in those precedents.”
Scarborough said Thomas’ hypocrisy was particularly “fascinating”: Why reconsider these landmark Supreme Court cases and not 1967’s Loving v. Virginia, which legalized interracial marriage in the U.S.?
Because Thomas’ wife, Ginni Thomas, is white, he said.

Numerous public figures have voiced criticism of the U.S. Supreme Court’s decision Friday to strike down the 1973 case that legalized abortion nationwide. In a solo concurring opinion, Thomas wrote that the same argument used to overturn the right to abortion, due to the majority opinion that it was not protected by the 14th Amendment, could similarly be used to overturn decisions granting rights to contraception and same-sex marriage.
Notably, Thomas’ opinion did not mention the possibility of losing the right to interracial marriage, protected by the 1967 Supreme Court case Loving v. Virginia.

Cleta Mitchell, one of a handful of lawyers who attempted to get the 2020 presidential election overturned on behalf of then-President Donald Trump in part by making baseless allegations of fraud, is now working with right-wing organizations to recruit an “army of citizens” in order to monitor elections, The New York Times detailed in a report Monday.
Through what is called the Election Integrity Network, Mitchell is working with groups like the Tea Party Patriots and the Republican National Committee, according to the report. The Election Integrity Network is part of the Conservative Partnership Institute,...

Supreme Court spouse Ginni Thomas not only pushed the Trump White House and Republican congressmen to try to overturn the results of the 2020 election, she also reached out to Arizona state lawmakers asking the same, The Washington Post reported Friday. This latest revelation raises still more questions and concerns about the extent to which Thomas’ role as a right-wing activist affects the work of her husband, Justice Clarence Thomas.
Ginni Thomas sent emails to Arizona House Speaker Rusty Bowers and State Rep. Shawnna Bolick, both of whom are Republicans.

We all knew Sean Hannity was doing the bidding of the Trump administration. We found out Monday he was doing it literally.
CNN on Monday published a slew of text messages between Trump Chief of Staff Mark Meadows and prominent Republican lawmakers and conservative figures — including Hannity. The Jan. 6 committee has already released several texts exchanged between Meadows and Hannity, but the ones released Monday are particularly striking, demonstrating just how firmly the White House had Hannity secured under its thumb.
“Hey. Nc gonna be ok?” Hannity wrote Meadows last Nov.

The House Jan. 6 committee possesses nearly 100 text messages from two Republican lawmakers urging then-White House Chief of Staff Mark Meadows to overturn the 2020 presidential election, CNN reported on Friday.
Utah Sen. Mike Lee and Texas Congressman Chip Roy supported former President Trump’s decision to not concede the election once it was called on Nov. 7, with Lee offering Meadows “unequivocal support for you to exhaust every legal and constitutional remedy at your disposal to restore Americans faith in our elections.”

The House Jan. 6 committee is in possession of a text that Donald Trump Jr. sent to Mark Meadows two days after the 2020 election in which he floated ways that his father could remain in office, CNN reported on Friday.
In the message, which was sent before a winner was even declared, Trump Jr. suggested a number of ways to achieve this. “It’s very simple,” he wrote to the White House chief of staff. “We have multiple paths We control them all.”

Whoopi Goldberg asked and answered her own question about Will Smith’s future Monday on The View, practically rolling her eyes as she read the set-up question for the “Hot Topic” discussion on Smith’s career.
“Some of Will Smith’s future projects are in question,” Goldberg said, reading the intro. “The question is does he have a path back?” After chuckling at her own question, she quickly followed with a dismissive, “Yes, of course he does. He’ll be fine. He’ll be back. No worries.”
Unlike last week’s View episodes, when Goldberg, who is a member of the Academy’s Board of Governors and a former Oscar host, discussed Smith’s slap of Chris Rock at length, she and the rest of the View panel today seemed weary of the exhausted topic and moved on fairly quickly.

Much like other celebrities, the hosts of “The View” are tired of talking about Will Smith slapping Chris Rock at the Oscars. But Ana Navarro had something to add Monday: Smith shouldn’t lose projects because of what happened.
In the aftermath of the incident, Netflix has reportedly put their next project with Smith, a film called “Fast and Loose” on hold. It’s not altogether unexpected, as several Hollywood experts told TheWrap last week that his work would take a hit, at least in the short-term. But Navarro doesn’t agree that should happen.
“Look, I’m so tired of talking about this, I’d like to slap myself,” Navarro said to preface her comments. “I really wish we were talking about Clarence Thomas and Ginni Thomas, because I think that has more of an effect on our lives. But, I understand that this has really struck a nerve with people,...

This week’s Saturday Night Live cold open didn’t kick off with a parody surrounding the Oscars slap, however, it did get a mention. Instead, the focus was on a handful of topics that the “Fox and Friends” crew decided to tackle, with hosts Steve Doocy (played by Alex Moffat), Ainsley Earhardt (Heidi Gardner) and Brian Kilmeade (Mikey Day).
The “hosts” first welcomed Clarence Thomas (Kenan Thompson) and Ginni Thomas (Kate McKinnon) who have become enmeshed in the Jan. 6 attack on the Capitol. “I take my duty as the...

If you were expecting to hear a lot about Will Smith’s slap of Chris Rock at the Oscars on March 27, tonight’s Saturday Night Live cold open didn’t have a lot to offer.
Sure, James Austin Johnson ‘s Donald Trump showed up towards the end to declare that “I saw slap, I enjoyed slap, I was very impressed with my Hitch.” Swirling around a few references to past flicks by the King Richard star, Johnson’s Trump went on to say “quite an arm on Hitch, I always knew Hitch had an arm.”
“Back in Pursuit of Happyness, he’s slugging the machine on and off the subway,” this season’s Trump rambled. “I thought it was great. You know, they slept in the bathroom in that movie. It’s so sad. it’s a sad night for Hitch too.”

If you were expecting this week’s “Saturday Night Live” to kick off with a sketch parodying the Will Smith/Chris Rock slap at the Oscars, you may have been disappointed by the cold open. (That came later.) The slap was indeed mentioned, but it was just one of several topics brought up as the show once again turned to a Fox News parody to lead the episode.
(Chris Redd played Smith in a sketch later, with host Jerrod Carmichael playing a seat filler sitting next to the star during the moment of the slap.)
This week, it was another go at “Fox and Friends,” featuring hosts Steve Doocy (played by Alex Moffat), Ainsley Earhardt (Heidi Gardner) and Brian Kilmeade (Mikey Day). The hosts welcomed Clarence Thomas (Kenan Thompson) and wife Ginni Thomas (Kate McKinnon) — whose support of the January 6 attempted coup has become a lightning rod for scandal.

“Saturday Night Live” took a couple of weeks off during what turned out to be an eventful period of time, newswise, so you’ve probably already guessed that the “SNL” cold open sketch for the April 2 episode tried to cover, well, all of them.
But rather than a targeted mock session or direct parody of, say, the one thing everyone has talked about for a week — Will Smith slapping Chris Rock at the Oscars — the show decided to do a really basic “Fox and Friends” parody instead, recapping the news but not really commenting on anything.
It started with the “SNL” version of the “Fox and Friends” crew talking about Donald Trump’s failing social media company and then about Ted Cruz. Then came Keenan Thompson as Clarence Thompson and Kate KcKinnon as his seditious wife Ginny.

Ginni Thomas regularly met with Donald Trump while he was president, often providing him lists of people whom he should fire and hire — one of which the White House suspected of being a foreign spy.

It was reported last week that Ginni Thomas, the right-wing activist and wife of Supreme Court Justice Clarence Thomas, sent several texts urging Trump Chief Staff Mark Meadows to work to overturn the 2020 election results. Days later, it was reported that she urged Republican lawmakers to do the same. These revelations, combined with Thomas’ previous admission that she attended the “Stop the Steal” rally that preceded the riot at the Capitol, have piqued the interest of the Jan. 6 committee.

The U.S. Supreme Court’s January 19, 2022 order in Trump v. Thompson was as brief as it was significant. By a vote of 8-1, with Justice Clarence Thomas as the lone dissenter, the Court refused a request by former president Donald Trump to block congressional investigators from gaining access to messages that Trump claimed were still covered by executive privilege. Those messages, between and among Trump administration officials during their final days in office, shed needed light on the origins of the Trump-fueled U.S. Capitol riot and insurrection, which...

Ginni Thomas, the right-wing activist wife of Supreme Court Justice Clarence Thomas, not only pushed White House Chief of Staff Mark Meadows to work to overturn the 2020 election results — she also urged Republican lawmakers to go “out in the streets” to protest the election, NBC News reported on Friday.

Ginni Thomas waged a QAnon conspiracy-fueled push to get White House Chief of Staff Mark Meadows to help overturn the results of the 2020 election at the same time her husband, Supreme Court Justice Clarence Thomas, was ruling on cases pertaining to it. Democrats, legal scholars, and other observers are calling for Thomas to recuse himself from future election-related cases. Republican Reps. Kevin McCarthy and Jim Jordan, however, aren’t too concerned. Neither is Senate Minority Leader Mitch McConnell.

The Washington Post‘s Bob Woodward and CBS News’ Robert Costa landed one of the week’s bigger D.C. scoops with a report that Ginni Thomas, the wife of Supreme Court Justice Clarence Thomas, texted then-White House Chief of Staff Mark Meadows urging him to contest the 2020 presidential election results.
“Help This Great President stand firm, Mark!!!…You are the leader, with him, who is standing for America’s constitutional governance at the precipice.
