Convicted serial sex offender Harvey Weinstein’s second rape trial, where he is facing 11 sexual assault charges involving five women in Los Angeles and Beverly Hills, is set to begin on Oct. 10, acording to Los Angeles D.A. Media Relations.
After jury selection, the trial is expected to last up to eight weeks, according to CBS news.
Weinstein was extradited last year from New York to Los Angeles. Weinstein’s lawyers had fought efforts to bring him to California and his extradition had been delayed repeatedly, due to both the Covid-19 pandemic and also because of claims that the L.A. County district attorney’s office had an issue with his extradition paperwork. That issue has since been resolved.

Medina Spirit, the three-year-old thoroughbred racehorse whose 2021 win at the Kentucky Derby drew controversy when he later tested positive for a corticosteroid, died this morning after collapsing after a track workout at Santa Anita Park in California.
According to the Paulick Report, a horseracing news publication, Medina Spirit collapsed following a five furlong workout, with a preliminary cause of death being a heart attack. The horse’s rider was unhurt.
The news was confirmed by the California Horse Racing Board’s Equine Medical Director Jeff Blea. A comprehensive necropsy including toxicology, forensics, and tissue sampling, will be performed at Uc Davis in San Bernardino, California. An attorney for Medina Spirit trainer Bob Baffert confirmed the death to the Associated Press.
Medina Spirit’s Derby win remains under dispute due to the positive test for betamethasone, a medication prohibited on race days. The Kentucky Horse Racing Commission has not yet held the required disqualification hearing.

The Los Angeles District Attorney has again indicted producer Harvey Weinstein, reviving a sexual battery charge that was dismissed by a judge last week. This is the fourth time the Los Angeles D.A. has indicted Weinstein.
Last week, Weinstein’s lawyers were successful in getting one of the 11 charges he faced dismissed by judge Lisa B. Lench on grounds related to the statute of limitations. Prosecutors have now issued a new indictment tied to the same incident, which includes seven additional findings based on the disputed count.
Weinstein now once again faces 11 charges of rape and sexual assault against five alleged victims.
Earlier in July, Weinstein pleaded not guilty to the 11 charges after being extradited to Los Angeles. The reported incidents took place between 2004 and 2013. The previously disputed charge — Count 5 — stems from an accusation from May 11, 2010, in which Weinstein was accused of assaulting a woman in a Beverly Hills hotel room.

Harvey Weinstein’s lawyers successfully dismissed one of 11 sexual assault charges that the former producer faces in his Los Angeles trial, with a judge ruling that it fell outside the statute of limitations.
Back in July, TheWrap reported that a judge rejected Weinstein’s bid to dismiss two of the charges against him but that a third count of sexual battery by restraint, or Count 5, would need to be amended. The prosecution did amend the charge, but a rep for the Los Angeles County District Attorney’s office told TheWrap that Count 5 was now dismissed by the judge.
“Mr. Weinstein faces very serious charges. Ten of the 11 counts stand. We are taking appropriate steps so that justice prevails in this case,” Alex Bastian, special advisor to the Los Angeles County Da, said in a statement to TheWrap.

Harvey Weinstein’s bid to dismiss two counts of sexual assault against the former movie producer in his Los Angeles trial have been rejected by a judge after Weinstein’s attorneys claimed they were precluded by the statute of limitations.
Judge Sergio Tapia II told prosecutors that a third count of sexual battery by restraint, or Count 5, would need to be amended, which the defense also challenged over statute of limitations.
Weinstein last week pleaded not guilty to 11 charges of rape and sexual assault after being extradited to Los Angeles. The charges are connected to rape and assault allegations from five women, with the reported incidents taking place between 2004 and 2013.

Harvey Weinstein pleaded not guilty to 11 counts of rape and sexual assault on Tuesday after being extradited to Los Angeles.
Weinstein only spoke once during the arraignment hearing, saying, “Thank you very much” after Judge Sergio Tapia wished him “good luck.” Weinstein was previously convicted of rape and sexual assault of two women in New York and sentenced to 23 years in prison.
Attorneys for Weinstein have filed a motion to dismiss three of the counts against him, arguing that the statute of limitations has expired. The charges are connected to rape and assault allegations from five women, with the reported incidents taking place between 2004 and 2013.
“Anyone who abuses their power and influence to prey upon others will be brought to justice,” Los Angeles District Attorney George Gascón said in a statement.
Weinstein was first charged by previous L.A. District Attorney Jackie Lacey in January 2020 during the early stages of Weinstein’s New York trial.

Updated, 11:18 Am: One day after being extradited to Los Angeles to face rape charges that could see him behind bars for up to 140 years, Harvey Weinstein made his first court appearance in the West Coast case on Wednesday morning.
The former movie mogul, already a convicted sex offender due to a successful prosecution last year in New York, entered a plea of not guilty through his attorney Mark Werksman.
The shackled and virtually silent Weinstein entered the Los Angeles Superior Court courtroom in a wheelchair, where he remained in the chair throughout the proceedings. The only words he uttered were a “thank you very much” after Judge Sergio Tapia wished the disgraced producer “good luck.”
The April indictment of Weinstein was unsealed today, laying out the full extent of the four counts each of forcible rape and forcible oral copulation, two counts of sexual battery by restraint, and one...

Harvey Weinstein could be heading out to Los Angeles within week to face multiple counts of sexual assault. Or not.
In a short, but somewhat convoluted virtual hearing this morning, the lawyer for the already imprisoned producer promised to throw a habeas corpus spanner in the works if the proceedings didn’t hit the reset button. If Weinstein’s attorney doesn’t not do that, then come May 30, LA officials will “make arrangements to have him transferred,” noted a masked Judge Kenneth Case on Friday.
It likely won’t be so straightforward.
“I intend to file,’ declared attorney Norman Effman to the Erie County courtroom on camera as Weinstein watched from his current maximum-security digs. “I will do it as quickly as possible, I won’t do it on the 29th day, but I won’t do it on the second day, “the East Coast lawyer added the clocking already...

With a new indictment coming down from a Los Angeles grand jury, Harvey Weinstein’s long delayed extradition hearing in upstate New York to face West Coast justice just hit the pause button anew.

In the faint hopes to move this much-mired matter along, Erie County Court Judge Kenneth Case wants paperwork from Weinstein’s attorney Norman Effman by April 20 and response from the local District Attorney by April 27.

Harvey Weinstein is set to appear virtually for an extradition proceeding before an Erie County Court judge in New York Monday afternoon for his LA rape charges. The hearing is set for 2 p.m. Et.
The extradition hearing comes after the producer was secretly indicted by a Los Angeles grand jury in an effort to expedite the process, according to a new report from Fox News. A representative for the Los Angeles District Attorney did not immediately return a request for comment.
The hearing has been delayed because of the ongoing coronavirus pandemic. Updated Exclusive: CAA has dropped Marilyn Manson as a client, sources told Deadline on Tuesday, a day after allegations of sexual and emotional abuse made by Evan Rachel Wood were followed by similar claims by other women.
The news comes after the singer and actor was dropped by his music label, and his performances in upcoming episodes of Starz’s American Gods and Shudder’s Creepshow would be scrubbed.
Manson in a statement Monday said the claims are “horrible distortions of reality.”
CAA had no comment today.
Fyi – Evan Rachel Wood continues to be represented by CAA.
Previously, Monday Pm: Already dropped by his label and possibly his agency, Marilyn Manson’s bloody stint on Starz’s American Gods is over now too.
The axing comes after Evan Rachel Wood publicly accused the long in the tooth shock rocker of “horrifically” abusing and “grooming” her when the Westworld actress was still a teenager.

Updated, 12:30 Pm: After several delays and postponements, Danny Masterson on Wednesday finally entered a plea to multiple rape charges, sort of.
That ’70s Show actor was not actually in court in downtown Los Angeles this morning for the arraignment hearing. However, his main defense lawyer Tom Mesereau said his client was pleading not guilty to claims that he sexually assaulted three women in the early years of the last decade.
First charged in June last year and out on bail of $3.3 million, Masterson or at least his case will be back in Los Angeles Superior Court in the early spring, the L.A. County D.A.’s office said after the hearing had concluded.

Updated, 2:35 Pm: With just six days to go in a tight Los Angeles County District Attorney’s race, incumbent Jackie Lacey’s office just unveiled seven new sexual assault charges against Ron Jeremy.
Involving five women and a 17-year-old girl, the new charges and previous claims could see 67-year-old porn star facing 330 years in state prison if found guilty. The rape and other sex crimes revealed today range from 1996 in the San Fernando Valley to 2013 in a West Hollywood bar.
What is equally chilling is that 14 other cases were denied by the L.A. D.A.’s office “because they were outside the statute of limitations.” All of the six cases allowed in today’s charges were from 2000 to 2013, except the 1996 incident, which involved a minor.

Exclusive: In the next few minutes, ‘Extraction’ executive producer David Guillod will turn himself in to law enforcement in Santa Barbara to face multiple charges of sexual assault.
The allegations center around three women, who have been identified as Jane Does by District Attorney Joyce Dudley’s office, I’ve learned. At least one of those cases is occurred at a corporate retreat in Santa Barbara in 2014, which is no small part why the over two-year investigation into claims against Guillod was shifted from the L.A. The Los Angeles district attorney added a new sexual assault charge against Harvey Weinstein on Friday.
In January, Weinstein was charged in L.A. with one felony count each of forcible rape, forcible oral copulation, sexual penetration by use of force and sexual battery by restraint; the charges were based on the accounts of two women who alleged that Weinstein sexually assaulted them in 2013. The new count announced on Friday — another count of sexual battery by restraint — is based on an accusation that Weinstein sexually assaulted a third woman in 2010 at a Beverly Hills hotel.
The new victim was first interviewed by the D.A.’s office in Oct. 2019 as a potential corroborating witness, but last month, she had provided detectives with information “confirming that the assault took place within the 10-year-statute of limitation,” according to the announcement.

Around 36 hours before Harvey Weinstein is set to discover how long he is going to prison for, the disgraced producer and convicted sex offender’s defense team today say they want the judge to low ball the sentence.
“Please accept this letter as our request that the Court sentence Mr. Weinstein to a period of incarceration of five years,” wrote attorneys Donna Routunno, Damon Cheronis and Arthur Aidala to Judge James Burke late this evening as the determining March 11 hearing looms (read the letter here).
Full of citations about the currently Rikers Island incarcerated Oscar winning producer’s charitable works, naming dropping Nelson Mandela and Paul Newman, the fact he is a “first-time offender” and more, the correspondence also comes just three days after the Manhattan District Attorney’s office essentially recommended to Empire State Supreme Court Judge Burke that he bury the 67-year old Weinstein and his “total lack of remorse.

Five days before sex offender Harvey Weinstein is due to be sentenced in a New York City courtroom, prosecutors made it clear they want the judge to throw the Oscar-winning producer in jail and toss away the key.
Listing off a multi-page recount of rapes and other sexual assaults of which the February 24-convicted Weinstein has been accused, Assistant D.A. Joan Illuzzi-Orbon on Friday vehemently condemned the man a jury found guilty of felony sex crime and rape charges. Set to stand before Judge James Burke in Lower Manhattan’s Criminal Courts building on March 11, Weinstein, currently incarcerated at Rikers Island, is looking at a sentence of five to 29 years.
The chief prosecutor doesn’t name a figure in today’s 11-page correspondence (read it here). Yet, you can pick up pretty easily what Illuzzi-Orbon is putting down when she states: “the People will ask the the Court to...

Less than a week before his sentencing hearing for multiple sex crimes, Harvey Weinstein is in an ambulance right now heading to New York’s notoriously tough Rikers Island.
Having been isolated in the Big Apple’s Bellevue Hospital with various ailments since a jury found the much-accused producer guilty of two of five felony charges on February 24, the often hobbling 67-year old Weinstein has finally been ruled in good enough health by the New York City Department of Correction to be moved to the prison’s vast North Infirmary Command.
Suffering from a blockage in his heart, Weinstein underwent mild surgery on Wednesday by doctors at the renowned hospital. “The procedure was a success and he will be carefully watched at the infirmary,” Weinstein spokesperson Juda Engelmayer confirmed to Deadline today.
Rikers is just under 10 miles from the 1st Avenue-located Bellevue and should take about 45 minutes in NYC traffic...

The presidential primaries tend to siphon all the oxygen away from local races, many of which have more direct impact on voters than whether such-and-so gets a few more delegates from a state. One vital measure in the arena of criminal and social justice that is being decided today where I live, Los Angeles, has captured national attention thanks in part to the organizer who led the effort to get it on the ballot — Patrisse Cullors, one of the three black women who founded the Black Lives Matter movement in...

Harvey Weinstein won’t be hauled into a City of Angels courtroom on rape charges for at least a few more weeks, but the now convicted and much accused producer is proving a potentially decisive factor in Tuesday’s primary election for Los Angles County District Attorney.
As incumbent Jackie Lacey tries to contain the blast radius over her husband this morning threatening Black Lives Matter protesters with a gun if they didn’t get off the couple’s Granada Hills property, the bid for the powerful D.A. job has tightened in the polls. Among other topics, the main contenders for the post are fighting over why multiple sexual assault charges were only made public against Weinstein in Los Angeles in January, on the first day of his rape trial in New York City.
“There’s no objective reason to wait years to bring these charges other than to aid her prospects of reelection,...

In her prolific career as a producer and director of journalistic documentaries, Australian filmmaker Eva Orner has tackled such subjects as the wars in Afghanistan and Iraq, asylum seekers in Australia, and Cuba’s most vulnerable people. Her fourth feature film, about disgraced hot yoga architect Bikram Choudhury, presented a new challenge: How to humanize an alleged rapist.
The searing and timely documentary, “Bikram: Yogi, Guru, Predator,” debuted on Netflix on Wednesday, and is certain to provoke renewed waves of shock and anger at how Choudhury has eluded justice for his many alleged crimes. But there’s one person Orner hopes is paying extra close attention: California Governor Gavin Newsom.
“I’m saying to Gavin Newsom, you know, I’m sure he watches Netflix a lot. Watch the film, call [L.A. District Attorney] Jackie Lacey and tell her to step it up and do something,” Orner told IndieWire during a recent phone interview.
