When Captain Cragen first introduces Dr. Huang he says that he is a psychiatrist with the FBI who is helping setup ViCAP (Violent Criminal Apprehension Program). However ViCAP was first setup in 1985, 16 years before this episode takes place.

The defendant is arraigned on eight major felonies: six counts of assault in the second degree (a violent class D felony), one count of rape in the first degree (a violent class B felony) and one count of murder in the first degree (a class A-I felony). Because of the murder one charge this is a capital case, if convicted the defendant could potentially be facing the death penalty. A judge would never grant bail to someone accused of a capital offense, a defendant that is facing the death penalty by definition has nothing left to loose and every reason to try and flee the jurisdiction.
