Forfeiture for Wrongdoing occurs when a party intentionally or wrongfully makes the declarant unavailable to testify. The party who wants hearsay evidence admitted under this exception must prove the opposing party's wrongdoing by a preponderance of the evidence. It was most notably used in the case of Michael D. Crawford v. Washington in 2004, where Crawford and his wife confronted Kenneth Lee over an allegation that Lee had attempted to rape Mr. Crawford's wife. Mr. Crawford stabbed Lee in the torso, claiming he had acted in self-defense when he believed Lee had picked up a weapon, which Lee denied. Despite being questioned by the police, Mrs. Crawford could not be compelled to testify by the state, since under Washington's spousal privilege law, a spouse cannot testify in court without the accused spouse's consent (except when a spouse is a complainant). Despite the defense counsel's objections on the grounds that Mr. Crawford would be unable to cross-examine his wife on her statement without waiving spousal privilege, the court allowed Mrs. Crawford's statement to be admitted on the basis that the statement was reliable, as it was partially corroborated by Mr. Crawford's statement to police.
