During the trial several cell phones interrupt to receive a message. In New York cell phones and other photographic and audio recording devices are not allowed, even if turned off. The reveal of the video could have been handled with more aplomb.
Judith Briggs says that New York Penal Code, Article 130.25 states that sexual intercourse with someone who is unable to consent due to being mentally disabled is rape. For the most part she is correct, however Article 130.25 is the crime of rape in the third degree, which deals mostly with statutory rape. Article 130.30 is rape in the second degree, which is the crime a person is charged with for having sexual intercourse with a person who cannot consent due to being mentally disabled.
