Before the statute of limitations was removed in a case of rape one, charges had to be filed within five years, so when the changes went into effect in 2006, that meant that any cases of rape one that occurred between 2001 and 2006 could be prosecuted, but since the limitation timer on any cases of rape one that happened before 2001 had already expired at the time the new law took effect it could not serve to revive the case. This is not only true in New York state but in all states.
